Esha Gupta is a Bay Street trained lawyer based in Toronto, Canada.


Esha practices in all aspects of corporate / commercial, intellectual property, advertising and technology law. Her practice focuses on brand protection and enforcement.

Esha has worked at two global law firms on Bay Street and served as Counsel - Wealth at a top four Canadian bank. She previously served as Group Counsel (Banking) at a subsidiary of Constellation Software Inc. (TSX: CSU), where she advised a global portfolio of FinTechs across North America, South America, and Europe.

Highly experienced in technology contracting and cross-border negotiation, Esha advises clients ranging from Fortune 100 companies to emerging technology businesses through every stage of the technology lifecycle, from acquisition and deployment to integration, negotiation, and dispute‑avoidance strategies. In addition to branding, she counsels clients on employment, IP licensing, cyber-security, privacy, data protection and risk management for AI adoption. Her practice also includes advising on a wide range of internet and e‑commerce matters, including legal and regulatory issues relating to online gambling and alcohol marketing in Canada.

Esha is the recipient of Osgoode Hall Law School’s Dean’s Gold Key Award as the “One-to-Watch” for exceptional leadership, professionalism and compassion in her career. Her work has been recognized by Canadian Lawyer Magazine’s Top 25 Most Influential Lawyers and York University’s Top 30 Under 30 Changemakers. She is a frequent speaker at universities, law societies, and industry forums, and a contributor to Banking [on] Blockchain, published by the American Bar Association. Esha judges various national advocacy competitions and lectured at her alma mater, Osgoode Hall Law School, and the Ted Rogers School of Management. She regularly writes and presents on cases involving privacy and cyber risks associated with AI adoption.


Community. A golden thread in Esha’s life is community service. Esha has taken active leadership roles in many important professional associations in the legal community. Esha is the owner of Mindful Lawyer Canada. The group was founded to tackle psychological distress, anxiety and depression across all areas of the legal fraternity. She also advocates for the advancement of women, equity and inclusion, mental health, and access to justice.

Boards. Before joining FACL as Vice President (External) and Chair of Mentorship, Esha worked with various national boards. She served as the Secretary of the Indo-Canada Chamber of Commerce (ICCC YP), Director of the Network of Indian Professionals of North America (NET IP) and founded a local chapter of the United Nations Development Program, a grassroots economic development organization. Maneesha has represented the City of Toronto as the official hostess of the International Indian Film Awards (IIFA).

Activities. Esha is a 2x 42.2 km marathon runner, competitive dragon-boat racer and dance performer.
